CDL Solutions ND - Terms of Service

By subscribing to the CDL Training & Compliance Subscription or CDL training One and Done offered by CDL Solutions ND ("we", "our", or "Company"), you ("Client" or "Customer") agree to the following terms:
Service Description
The subscription includes access to CDL training tools and curriculum, which consists of both proprietary content and open-source video materials. Clients also receive consulting support for setup, trainee registration, training completion documentation, and general inquiries. Secure digital storage of training records is provided for compliance purposes.
Clients may add and train drivers at any time during their active subscription, with full access to instructional materials, progress tracking, and support.
Payment Terms

CDL Training and Compliance Subscription 1: The subscription is billed monthly at $299 with a setup fee of $299 (limited to one student at a time training)

CDL Training and Compliance Subscription 2: The subscription is billed monthly at $399 with a setup fee of $399 (limited to 3 students at a time training)

CDL Training One and Done: Billed monthly at $14.99 with a setup fee of $1,800 (limited to one student total; upgrades to other plans available)

After one year you can:

Keep your same plan if it fits your current needs

Keep your account active for $99.00 per month and just pay $499.00 when you have a student to train (your monthly rate will not go up if you train a student).

Audit only allows CDL Solutions ND to continue storing and managing your required records at a reduced rate of $49/month (no students will be enrolled)

All payments, including setup fees and monthly charges, are non-refundable once processed.
Monthly subscription charges are billed on the anniversary date of your initial signup. Setup fees are one-time charges due upon subscription. If a payment fails, access for all users of your company will be suspended within 24 hours. Late payments may result in additional fees or loss of access to training records.
FMCSA Compliance & Record Retention
Under FMCSA 49 CFR § 380.725, clients are required to retain training records for 3 years after each student completes training.
To fulfill this requirement, your subscription must remain active and uninterrupted for a period of 3 years following the most recent student’s completion of training.
Failure to maintain an active subscription during the retention period may result in the loss of access to training records and could place your company out of federal compliance.

Cancellation Policy
During any period in which your company is subject to federal record retention requirements, you may not fully cancel your subscription. You may transition to Audit Mode one year after your final student’s completion date
Audit Mode allows CDL Solutions ND to continue storing and managing your required records at a reduced rate of $49/month until the 3-year retention period is complete (36 months after the final student’s completion).
You may fully cancel:

After 36 months of inactivity (no new student completions), or
-
After fulfilling your final student’s 3-year retention requirement via Audit Mode
Upon full cancellation, access to training tools, support, and records will be terminated.

Training Record Access
CDL Solutions ND will maintain training records in accordance with FMCSA requirements for the duration of the required 3-year retention period.
Training records remain securely hosted by CDL Solutions ND and are accessible only during an active subscription or Audit Mode. At this time, downloadable or exportable copies of training records are not available.
Clients are responsible for maintaining an active subscription to ensure continued access for compliance purposes.

Audit Requests by FMCSA or Other Authorities
In the event of a formal compliance audit or investigation, CDL Solutions ND will provide authorized government agencies, including the Federal Motor Carrier Safety Administration (FMCSA), with secure digital access to all required training records, curriculum, and supporting documentation.
This access will be limited to materials directly related to the audit and only for the duration of the audit or review process. The Client agrees to notify CDL Solutions ND immediately upon receiving notice of any such audit or investigation that may require training record access.

System Availability & Continuity
While CDL Solutions ND aims for 99% uptime, routine maintenance or unexpected outages may occur. In the event of temporary system unavailability, training activities may resume and be logged once the system is back online. No downloadable records are provided; all records remain stored and accessible only through the platform.
In the event of a federal audit during downtime, CDL Solutions ND will confirm record availability and system status in writing. Should CDL Solutions ND cease operations, a good faith effort will be made to provide secure access to retained records through an alternative means for the duration of the required retention period

Data Security & Privacy
CDL Solutions ND uses secure cloud-based systems with role-based access control to manage sensitive training records. Data is not shared with third parties except as required for compliance with federal audits. Clients are responsible for maintaining the confidentiality of their login credentials.

Acceptance of Terms
By completing your subscription payment, you acknowledge and agree to these Terms of Service.
These Terms of Service may be updated periodically. Continued use of services constitutes acceptance of any updated terms.
It is the Client's responsibility to read, understand, and comply with all terms before subscribing.
